1. Who We Are

GetFixHero / FixHero is a technology platform operated by GetFixHero Home Services Inc., 350 Bay St., Suite 1300B, Toronto, ON M5H 2S6, Canada (“GetFixHero”), that helps connect people seeking repair, maintenance, installation, field, home, or related services (“Customers”) with independent service providers, contractors, technicians, tradespeople, vendors, or other operators (“Operators”).

2. Nature of the Platform

GetFixHero is not a repair company, contractor, field service provider, employer, staffing agency, broker, insurer, or guarantor of any services offered or performed through the Platform.

Our role is limited to providing a software platform and related tools that allow Customers and Operators to find one another, communicate, schedule work, manage workflows, and, where available, facilitate related transactions.

Any service relationship is strictly between the Customer and the Operator.

3. Eligibility

You may use the Platform only if you are at least 18 years old, have the legal capacity to enter into binding agreements, and comply with these Terms and all applicable laws.

4. Accounts

To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activities that occur under your account.

5. Customer Terms

If you use the Platform as a Customer, you acknowledge and agree that you are solely responsible for deciding whether an Operator is suitable for your needs; any arrangement is solely between you and the Operator; and GetFixHero does not guarantee quality, safety, licensing, insurance, timeliness, pricing, or outcome of any Operator's services.

6. Operator Terms

If you use the Platform as an Operator, you act as an independent business and not as an employee of GetFixHero. You are solely responsible for the services you offer, legal compliance, licensing, insurance, taxes, your personnel, and your performance.

7. No Employment, Agency, or Partnership

Nothing in these Terms creates any employment, agency, partnership, joint venture, fiduciary, franchise, or similar relationship between GetFixHero and any Customer or Operator.

8. Quotes, Pricing, Payments, and Transactions

The Platform may include tools for estimates, quotes, approvals, invoices, scheduling, messaging, or payments provided for convenience only. Unless expressly stated otherwise, GetFixHero is not a party to any service contract between a Customer and an Operator.

9. Scheduling, Cancellations, and No-Shows

Scheduling tools are provided as a convenience only. GetFixHero does not guarantee appointment availability, punctuality, attendance, completion, or fulfillment. Issues involving cancellation, rescheduling, delay, or no-shows are the responsibility of the Customer and Operator.

10. User Conduct

You agree not to violate any applicable law, post false or harassing content, impersonate any person, interfere with the Platform, scrape or reverse engineer the Platform, or engage in unsafe or deceptive conduct.

11. User Content

You retain ownership of your User Content but grant GetFixHero a worldwide, non-exclusive, royalty-free license to host, use, reproduce, modify, and distribute it as reasonably necessary to operate the Platform.

12. Reviews and Ratings

Ratings and reviews reflect user opinions only and do not constitute endorsements by GetFixHero. We reserve the right to remove reviews for fraud, abuse, or policy violations.

13. Verification and Screening Disclaimer

GetFixHero may, but is not obligated to, perform identity checks or credential verification. Any such checks are limited in scope and GetFixHero does not warrant that any user is trustworthy, qualified, licensed, or insured.

14. Assumption of Risk

Your use of the Platform and interactions with other users are entirely at your own risk, including risks relating to personal injury, death, property damage, theft, defective work, delays, fraud, misrepresentation, and any other losses arising from services facilitated through the Platform.

15. Customer-Operator Responsibility for Disputes

Any service relationship formed through the Platform is solely between the Customer and the Operator. GetFixHero shall not be held liable for the acts, omissions, or legal violations of any Customer or Operator.

16. Release

To the fullest extent permitted by law, each Customer and Operator releases GetFixHero, FixHero, and their affiliates from any and all claims arising out of user conduct, service quality, personal injury, property damage, or disputes between users.

17. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” GetFixHero disclaims all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, or non-infringement.

18. Limitation of Liability

To the fullest extent permitted by law, GetFixHero shall not be liable for any indirect, incidental, special, consequential, or punitive damages. GetFixHero's total aggregate liability shall not exceed the greater of amounts paid by you to GetFixHero in the prior six months or US$100.

19. Indemnification

You agree to defend, indemnify, and hold harmless GetFixHero, FixHero, and their affiliates from any claims, liabilities, damages, costs, and expenses arising out of your use of the Platform, breach of these Terms, or interactions with other users.

20. Binding Arbitration and Dispute Resolution

To the fullest extent permitted by law, any dispute arising out of or relating to the Platform or these Terms shall be resolved by binding arbitration in the United States on an individual basis, administered by the American Arbitration Association (AAA), seated in Delaware, USA. No class actions are permitted. This section survives termination.

Your rights under Ontario law are not affected. Nothing in these Terms limits your rights under the Consumer Protection Act, 2002 (Ontario) or other applicable consumer protection legislation, including your right to commence or join a class proceeding, and including any right to bring a matter before the courts of Ontario. Where anything in this section conflicts with those rights, those rights prevail.

21. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles, except as superseded by the Federal Arbitration Act.

Your rights under Ontario law are not affected. GetFixHero Home Services Inc. is an Ontario corporation and this section does not displace the protections available to you under the law of your own province. Nothing in these Terms limits your rights under the Consumer Protection Act, 2002 (Ontario) or other applicable consumer protection legislation. Where anything in this section conflicts with those rights, those rights prevail.

22. Intellectual Property

The Platform is owned by or licensed to GetFixHero / FixHero and is protected by intellectual property laws. You are granted a limited, revocable, non-exclusive license to access and use the Platform for its intended purpose.

23. Third-Party Services

The Platform may integrate with third-party services such as payment processors, communications providers, and analytics tools. We are not responsible for third-party services.

24. Privacy

Our collection, use, and disclosure of personal information are governed by our Privacy Policy, incorporated into these Terms by reference.

25. Suspension and Termination

We may suspend, restrict, or terminate your access to the Platform at any time for any lawful reason. Termination does not affect provisions that by their nature survive, including disclaimers, releases, limitations of liability, indemnification, and dispute resolution.

26. Changes to These Terms

We may update these Terms from time to time. Updated Terms become effective when posted. Your continued use of the Platform constitutes acceptance of the revised Terms.

27. Miscellaneous

If any provision is found unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and GetFixHero regarding the Platform. You may not assign these Terms without our prior written consent.
