1. Who this agreement is between
This agreement is between GetFixHero Home Services Inc., 350 Bay St., Suite 1300B, Toronto, ON M5H 2S6, Canada ("GetFixHero", "we", "us") and the business or individual that accepts it at signup (the "Operator", "you"). It governs your use of the GetFixHero platform to receive job requests from homeowners in the Greater Toronto Area.
By ticking the acceptance box at signup you confirm that you have read this agreement, that you have authority to bind your business to it, and that the information you gave us at signup is true.
2. You are an independent business
You are an independent contractor. Nothing in this agreement creates an employment, agency, partnership, joint-venture or franchise relationship between you and GetFixHero.
In practice that means, and we will run the platform so that it stays true:
- You set your own prices. Your diagnostic fee, emergency call fee and job pricing are yours. We do not set them, approve them or take a share of them.
- You may decline any job, for any reason, without penalty. Declining or letting an offer time out does not affect your standing, your ranking or your subscription.
- You use your own tools, vehicle, insurance and licences.
- You are free to work for anyone else, including other platforms and your own customers, at any time.
- You are responsible for your own taxes, including HST registration and remittance where required, CPP and any WSIB premiums.
You are responsible for the work you perform, for anyone you bring to a job, and for compliance with every law that applies to your trade.
3. Who can be on the platform
To receive jobs you must be at least eighteen, operate a lawful business in Ontario, and hold every licence, certification and registration that the work you accept requires. For plumbing work that means, at minimum, a Certificate of Qualification (Plumber 306A) or registered apprenticeship under supervision, and a City of Toronto Plumbing and Heating Contractor licence where the work is in Toronto. Gas work requires TSSA certification at the appropriate level.
You may join the platform without a trade licence to perform general handyman work only. The platform limits you to job types your credentials permit. You must never accept or perform work reserved to a compulsory trade that you are not certified in.
You must tell us within five business days if any licence, certification or registration you have declared is suspended, expires, or is withdrawn.
4. Insurance and statutory coverage
4.1 Required coverage. Throughout the term of this agreement, and for twenty-four (24) months after it ends, you shall maintain at your own expense, with insurers licensed in Ontario holding an A.M. Best rating of A- or better:
(a) Commercial General Liability insurance on an occurrence basis with limits of not less than CAD $2,000,000 per occurrence and CAD $5,000,000 in the annual aggregate, covering bodily injury, property damage, personal and advertising injury, products and completed operations, contractual liability, and non-owned automobile liability. The coverage shall extend to damage to property in your care, custody or control, or you shall maintain separate coverage of not less than CAD $2,000,000 for such damage. Where you perform work on gas-fired appliances or gas piping, the per-occurrence limit shall be not less than CAD $5,000,000;
(b) Automobile Liability insurance on all vehicles used in connection with the services, with a limit of not less than CAD $2,000,000 per occurrence, written for commercial use. You acknowledge that a personal automobile policy is not sufficient where a vehicle is used for business; and
(c) WSIB coverage in good standing, or, where you are lawfully exempt from compulsory coverage, written evidence of the basis of that exemption together with your undertaking to notify us within ten (10) days if the exemption ceases to apply.
4.2 Additional insured. You shall cause GetFixHero Home Services Inc. to be named as an additional insured under the policy in 4.1(a) with respect to liability arising out of your operations. That insurance shall be primary and non-contributory with any insurance maintained by GetFixHero, and shall contain a waiver of subrogation in favour of GetFixHero and a cross-liability or severability of interests provision.
4.3 Evidence and notice. You shall deliver a certificate of insurance evidencing the required coverage before performing any services, and thereafter no later than the expiry date of each policy. Each policy shall provide for thirty (30) days' prior written notice to GetFixHero of cancellation, material alteration or lapse, or fifteen (15) days for non-payment of premium. You shall notify us within five (5) business days of becoming aware of any cancellation, lapse, material reduction in limits, or claim that may erode the aggregate below the required amounts.
4.4 Suspension for non-compliance. If valid evidence of the required coverage is not on file, has expired, or has been withdrawn, we may suspend your eligibility to receive job assignments immediately and without liability. Suspension under this section is administrative, not a termination, and eligibility resumes as soon as satisfactory evidence is delivered.
4.5 No assumption of risk. The insurance required here is a minimum and does not limit your liability under this agreement. You remain solely responsible for the services. GetFixHero introduces homeowners to independent operators; it does not perform the services, does not supervise or direct how they are performed, and is not a party to your contract with the homeowner.
5. How jobs work
One job, one operator. When a homeowner request matches your trade, area and availability, we offer it to you by SMS with a link to the job and a countdown. We offer each job to one operator at a time. We never send the same job to several operators to bid against each other, and we never resell a job.
Accepting. If you accept within the countdown, the job is yours and the homeowner's name, full address and phone number are released to you. If you decline or the countdown expires, the job goes to the next eligible operator and you receive none of the homeowner's details.
Before you accept you see the general area (the first three characters of the postal code), the problem type and the urgency. That is enough to decide; it is deliberately not enough to contact the homeowner outside the platform.
Once you accept you commit to contacting the homeowner promptly, attending at the agreed time, and completing the work or telling us immediately if you cannot. An accepted job that you abandon without telling us is the one thing on this platform that damages your standing.
Availability. You control when you receive offers. Set yourself unavailable and you will not be offered jobs; there is no penalty for being unavailable.
6. Price and conduct rules
These are the commitments we make to homeowners on your behalf. You agree to honour them on every job.
- A price before the work starts. Any call-out, diagnostic or minimum charge must be disclosed to the homeowner before you attend, not on their doorstep. The fees you enter at signup are what we tell homeowners to expect.
- Sign-off before the scope changes. If you find a bigger problem once work begins, get the homeowner's agreement to the revised price before continuing. Never present a larger bill afterwards.
- Confirm the price in the platform. When prompted, confirm the quoted price before work begins and again if the scope changes. We keep a timestamped record and will produce it for both sides if there is a dispute.
- Treat the homeowner and their property with respect. No pressure selling, no invented faults, no "I don't have the part" to manufacture a second call-out.
- Do the work to the standard your licence requires, obtain permits where the work needs them, and comply with the Ontario Building Code and every applicable law.
Repeated or serious breaches of this section lead to suspension under section 14.
7. No commission, no exclusivity, no fines
We want these three things to be as binding on us as the rest of this agreement is on you.
No commission. Your fee to GetFixHero is your subscription, and any optional add-on you choose. We take no percentage of any job, no lead fee and no share of your diagnostic or emergency fees. You keep 100% of what the homeowner pays you.
The homeowner is your customer. Once a job is complete, the homeowner is free to call you directly for future work, and you are free to serve them. We do not track, restrict or charge for repeat business.
No exclusivity and no penalties. You may use any other platform, advertise anywhere, and take work from any source. We will never fine you, demote you or restrict you for work done off the platform.
The only thing we ask in return: jobs that arrive through GetFixHero are accepted and completed through GetFixHero, so the record in section 6 exists if either side ever needs it.
8. Your subscription
Plans and prices. The plan you chose at signup, its monthly price in Canadian dollars, and any add-on you selected are shown at getfixhero.com/pricing and on your signup review screen. Those are the prices that apply to you. There is no signup fee. Any promo code you applied is recorded on your account with its terms.
Free trial. Your subscription begins with ninety (90) days at no charge. No payment method is required to sign up or to claim your site. A payment method is required only when you switch on routed jobs, and it is not charged during the trial. Billing begins the day after the trial ends unless you cancel before then.
Billing. Your subscription is billed monthly in advance to the payment method you provide. HST is added where applicable. If a payment fails we will retry and notify you; if it is not resolved within fourteen days your eligibility to receive jobs is suspended until it is.
Testing period. While GetFixHero is in testing mode, no payment is collected. Your plan and fees are recorded and billing begins only when we notify you that the platform is live, with at least fourteen days' notice. You may cancel before that date at no cost.
Cancelling. You may cancel at any time. Cancellation takes effect at the end of the current billing period; you keep receiving jobs until then. We do not refund partial months.
Price changes. We may change plan prices with at least thirty (30) days' written notice. A price change never applies to a billing period you have already paid for.
Subscription fees are non-refundable except where the law requires. Cancel before your ninety (90) free days end and you pay nothing at all.
9. Homeowner information
When you accept a job we give you a homeowner's name, address and phone number. That information is confidential and is provided for one purpose: performing that job.
You agree to:
- Use it only to contact the homeowner about, and to perform, the job you accepted.
- Not add the homeowner to any marketing list, share their details with anyone else, or sell them, without the homeowner's own express consent.
- Delete or securely dispose of the information when it is no longer needed for the job, your invoicing, or any warranty you gave, and in any case within two years.
- Protect it with reasonable safeguards and tell us within twenty-four (24) hours if it is lost, stolen or accessed without authority.
- Comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada's Anti-Spam Legislation (CASL) in every message you send.
A homeowner who chooses to call you directly for future work has given you their information themselves; this section does not restrict that relationship.
10. Your public page
We create and host a public page for your business on getfixhero.com, built from the information you give us and carrying your business name and branding with GetFixHero secondary. You grant us a non-exclusive, royalty-free licence to use your business name, logo, photos and descriptions for that page and for routing jobs to you, for as long as this agreement is in force.
We may edit the page for accuracy, legal compliance or consistency with the platform, and will tell you when we do. We display only credentials we have verified at source; we will not display a licence or certification you have claimed but we have not confirmed.
You confirm that everything you give us for the page is true and that you have the right to use any logo or image you supply. When this agreement ends we take the page down within seven days.
11. Reviews, ratings and standing
Homeowners may rate and review completed jobs. Reviews reflect their opinion and are not our endorsement. You may respond to a review publicly. We remove reviews we reasonably believe are fraudulent, abusive or written by someone who did not use your service, and we tell you when we do.
Your standing on the platform reflects completed jobs, homeowner feedback and whether you honour accepted jobs. It is never affected by declining an offer, by being unavailable, or by work you do elsewhere.
12. Safety and reporting
You enter people's homes. If you reasonably believe you have seen something that indicates a risk to a person's safety or a serious crime, you may report it to the police, a children's aid society or any other lawful authority. We will not penalise you for a report made in good faith, and it is not a breach of section 9.
You may leave any job site where you reasonably believe your safety is at risk. Tell us immediately so we can reroute the job, and that withdrawal will not count against your standing.
13. The platform
The GetFixHero platform is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error-free, or that it will deliver any particular volume of jobs. Job volume depends on homeowner demand in your area, your availability and your standing; we make no promise about it.
We will correct defects within a reasonable time, prioritised by harm. We are not liable for loss caused by an outage, a delayed or undelivered message, or the failure of a third-party service including SMS carriers, payment processors and hosting. If a job offer does not reach you because of a platform fault, the remedy is that we tell you and route the next suitable job to you.
14. Liability, indemnity and suspension
Your responsibility
You are solely responsible for the services you perform, for any person you bring to a job, and for any loss, injury or damage arising from your work or conduct. You shall indemnify, defend and hold harmless GetFixHero, its directors, officers and employees from any claim, loss, damage, liability, cost or expense (including reasonable legal fees) arising out of your performance of or failure to perform the services, your breach of this agreement, or your breach of any law.
Our liability
To the extent the law allows, GetFixHero's total liability to you for any claim connected with this agreement or the platform is limited to the subscription fees you paid us in the twelve (12) months before the claim. We are not liable for lost profits, lost jobs, or any indirect or consequential loss.
Suspension
Administrative suspension applies automatically when required insurance, a required licence, or your subscription payment lapses. It is not a penalty. You stop receiving job offers and your standing is unaffected; offers resume as soon as the lapse is cured.
Conduct suspension applies where we reasonably believe you have breached section 6 or 9, abandoned an accepted job, or acted in a way that endangers a homeowner or brings the platform into disrepute. We will tell you the reason in writing and give you the chance to respond before any suspension longer than seven days. Serious cases, including any credible safety concern, may be suspended immediately.
15. Term and ending this agreement
This agreement starts when you accept it and continues until ended. You may end it at any time by cancelling your subscription; section 8 says when cancellation takes effect. We may end it on thirty (30) days' written notice for any reason, or immediately for a serious breach, a credible safety concern, or if you cease to hold a licence or insurance the work requires.
When this agreement ends: you receive no new job offers; you must complete any job you have already accepted or tell us immediately so we can reroute it; your public page comes down within seven days; and sections 4 (for the period stated there), 9, 14, 16 and 17 continue to apply.
16. If we disagree
If a dispute arises between you and GetFixHero, we both agree to try to resolve it first by direct discussion. Either of us may ask for that in writing, and we will each make a senior person available within ten business days.
If that fails, either of us may propose mediation in Toronto with a mutually agreed mediator, costs shared equally. Mediation is voluntary.
Any claim that is not resolved may be brought in the courts of Ontario, which have exclusive jurisdiction. This agreement is governed by the laws of Ontario and the federal laws of Canada applicable in Ontario.
A dispute between you and a homeowner about the work is between you and the homeowner. We will provide the records we hold, including the price confirmations in section 6, to both sides on request.
17. General
Changes. We may change this agreement with at least thirty (30) days' written notice by email. A change does not apply to a job you have already accepted. If you do not accept a change you may end the agreement before it takes effect; continuing to use the platform after that date means you accept it. We will ask you to re-confirm acceptance in the platform for any material change.
Notices are effective when sent by email to the address on your account, or to ours in section 18.
Assignment. You may not assign this agreement. We may assign it to a successor to our business on notice to you.
Entire agreement. This agreement, the plan and fees shown at signup, and the Privacy Policy are the whole agreement between us about the platform. If any part is unenforceable the rest continues.
Language. The parties have required that this agreement be drawn up in English.
